Fontsera App License Agreement
This End User License Agreement ("Agreement," "EULA," or "License") is a contract between you (“Licensee”) and Fontsera.
Please read this Agreement carefully. By purchasing, downloading, installing and/or using the Font Software supplied by Fontsera, you are agreeing to the terms of this Agreement.
1. Binding Agreement
You (“Licensee”) are bound by this Agreement and acknowledge that all Use of the Font Software supplied by Fontsera is governed by this Agreement.
We perpetually reserve the right to modify or amend this Agreement in any way what-so-ever, at any time and without notice given.
2. License Grant
Fontsera grants Licensee a perpetual, worldwide, non-exclusive, non-transferable license to embed the Font Software into a Mobile, Desktop, or Video Game Application. The license granted in this section 2 (License Grant) is subject to all of the terms and conditions of this Agreement.
3. Usage
This App License allows Licensee to embed the Font Software into a Mobile, Desktop, or Video Game Application owned or controlled by Licensee (whether for Commercial use or Non-Commercial use), in a secure manner which does not allow an End User to access the Font Software outside of the Application; and distribute worldwide such Application to End Users. The Font Software must be embedded in only the number of Application Titles selected at checkout and stated in the Receipt.
If you just need a Font Software to create static images, purchasing a Desktop License is sufficient.
4. License Titles
A “Title” is one (1) standalone application and excludes all other versions aside from a replacement version that contains only bug fixes. If another similar, subsequent application (sequel, prequel, or other new version) is created, another App License must be purchased to embed the Font Software in this subsequent application.
5. License Specific Restrictions
Use of the Font Software is subject to the following restrictions:
(a) Licensee may NOT redistribute the Font Software together with the Application source code.
(b) Licensee may NOT use the Font Software for desktop use.
(c) Licensee may NOT embed the Font Software in websites, web applications, and electronic publications.
(d) Licensee may NOT embed the Font Software in any Application that allows the generation of output such as PDFs, word processing documents, spreadsheets, labeled photos, static images, scalable images, advertisements or other documents or data files, or in any Application that is a server component in a client/server architecture.
(e) Licensee may NOT use the Font Software in any application allowing an unlicensed end user to customize a digital or physical product to their specific needs using the Font Software, such as an “print on demand”, “on demand”, “made to order” or “build it yourself” applications.
(f) Licensee may NOT install the Font Software in the operating system on which the Application runs.
6. Font Software Protection
Licensee agree to take appropriate actions to protect the Font Software from any unauthorized use or access from unlicensed parties. This includes but is not limited to installing adequate technical protection measures that restrict the Use of and/or access to the Font Software.
7. Third Parties
Licensee may temporarily provide the Font Software to a iOS or Android developer, software developer, agent, or independent contractor who is working on behalf of the Licensee only if they agree in writing to use the Font Software exclusively for your work, agree in writing to the terms of this Agreement, and retain no copies of the Font Software on completion of the work. Allowing use of the Font Software by any third party in any other circumstance is prohibited.
8. Ownership
This Font Software is licensed—not sold—to the Licensee by Fontsera on behalf of the Shop Owner, and is licensed for use in accordance with the terms of this Agreement. As a Licensee, you become a licensed user NOT an owner of the Font Software.
9. Modifications
Licensee may NOT modify the Font Software, or create Derivative Works from the Font Software without prior written consent from Fontsera or the Shop Owner.
10. Restrictions
Licensee may NOT sell, lease, sublicense, share, distribute, adapt, modify, alter, translate, convert, change, reverse engineer, decompile, disassemble, attempt to discover the source code, or create derivative works from the Font Software without prior written consent from Fontsera or the Shop Owner. Fontsera and the Shop Owner expressly reserve the right to create any such modifications, derivations or adaptations.
11. Copyright
The Font Software is protected by copyright law. The Shop Owner is the sole, exclusive owner of all intellectual property rights, including rights under copyright and trademark law. The Licensee agrees that the Font Software, its structure, organization, code, and related files are property of the Shop Owner and that any intentional or negligent use of the Font Software not expressly permitted by the Agreement constitutes an infringement of intellectual and industrial property rights.
12. Trademarks
Licensee may NOT register, or apply to register, a trademark, design mark, service mark, or tradename, that uses the Font Software (in whole or in part); or claim ownership rights in an attempt to prevent any third party from using that Font Software. Trademarks can only be used in reference to output produced by the Font Software. Referring to a trademark does not give the Licensee any ownership rights for that trademark. Licensee may not change any trademark or trade name designation for the Font Software.
13. Limited Warranty
The Font Software is delivered without any warranties of any kind, either express or implied, including commercial warranties and warranties of fitness for any particular use. Fontsera and the Shop Owner shall in no event give any technical support on how to use the Font Software on your system. Fontsera and the Shop Owner shall in no event be liable to the Licensee for any consequential or incidental damages caused by the use or inability to use the Font Software, including any lost revenue, profits, goodwill or savings, or for any claim by any third party.
14. Termination
Fontsera has the right to terminate your license immediately if Licensee fail to comply with any of the terms listed in this Agreement. Upon termination, Licensee must destroy the original and any copies of the Font Software. The termination of this Agreement shall not preclude Fontsera from taking legal action for any breach of this Agreement.
