This website is operated by Fontsera a brand by Youssef Boufelja (Morocco Registered Company Number (ICE) 002329295000052, B.P 45, AIN TAOUJDATE ), our website (www.fontsera.com , “Fontsera”). Throughout the site, the terms “we”, “us” and “our” refer to Fontsera.

Fontsera offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By accessing this website and/ or purchasing, downloading our digital content (free or paid), now or in the future from us, you engage in our “Service” and agree to be bound by the following Terms of Service or what we officially call our Terms of Service (the “Terms” for short), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, Sellers, Buyers, merchants, and/ or contributors of content.
Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service as the same may be revised from time to time. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.
Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website which may be modified from time to time at our sole discretion, with or without notice to you. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

2. Those Other Terms That May Apply To You
If you use any of our Services, you agree to our Privacy Policy, These Terms set out the terms on which we process any personal data we collect from you, or that you provide to us and which sets out information about the cookies on our site. By using our site, you consent to such processing and you warrant that all data provided by you is accurate.

If you purchase and/or download fonts from Fontsera, you agree to our Licenses Terms collectively referred to as “End User License Agreement”), These Additional Terms govern your use of the fonts supplied to you by Fontsera.

3. Your Use of Our Services.
Fontsera provides a marketplace where Users can buy and sell fonts. Our Service allows for a buyer ("Buyer") to purchase a limited license to use fonts from shops opened on Fontsera by independent creators ("Sellers"). References to "buying" or "purchasing" fonts means buying or purchasing limited licenses to these fonts.
A. Eligibility.
You may use the Service only if you can form a binding contract with Fontsera, and only in compliance with these Terms and all applicable local, state, national, and international laws, rules and regulations. Any use or access to the Service you warrant that if an individual, you are at least 18 years old. If you are under the age of 18, you should ask a parent or guardian over the age of 18 to enter into these terms on your behalf. As a parent or guardian of someone under the age of 18, you are responsible for ensuring that person's use of the site is in accordance with these terms. The Service is not available to any Users previously removed by Fontsera
B. License Terms.
Fontsera offers thousands of fonts, fonts are licensed, not sold, to you, your use of any font is subject to the applicable License (outlined in Licenses Terms). If there is any conflict between the terms in the Terms of Service and the Licenses Terms, then the Licenses Terms will apply to the extent of that conflict.
C. No ownership.
By downloading or registering an Item you're not actually acquiring ownership of the Item itself, only the license to use that Item. Items are subject to specific terms of use, and these terms are set out in Font Licenses.
D. Fontsera Service.
Subject to the terms and conditions of these Terms, you are hereby granted a non-exclusive, limited, non-transferable, freely revocable license to use the Service for your use only as permitted by the features of the Service and by these Terms. Fontsera reserves all rights not expressly granted herein in the Service and the Fontsera Content (as defined below). Fontsera may terminate this license at any time for any reason or no reason.
E. Fontsera Accounts.
Your Fontsera account gives you access to the services and features that we may establish, maintain, and modify, from time to time and in our sole discretion. We may maintain different types of accounts for different types of Users. By connecting to Fontsera with a third-party service, you give us permission to access and use your information from that service as permitted by that service, and to store your login credentials for that service. You are responsible for tracking all activity on your own account, and you agree to the following:
• To store all passwords and usernames securely.
• To notify Fontsera of any unauthorized use or security breach. Fontsera will not be liable for any liability, damage, cost, loss or expense caused by or in connection with any unauthorized use of your account.
• To never share login details or account access to any third party.
• To accept responsibility for activity that occurs under your account(s).
• To never transfer or "sell" your account to another person.

4. Notifications and Emails.
By providing Fontsera your email address, you consent to Fontsera using the email address to contact you. Primarily, these messages are delivered by email, or by push notifications for a variety of reasons, including marketing, transactions, advocacy, and service update purposes. If you no longer wish to receive push notifications, you can disable them at device level. You can opt out of receiving marketing communications via email by following the unsubscribe link in any marketing email you receive. To ensure you properly receive notifications, we will need to collect certain information about your device, such as operating system and user identification information. Every account is required to keep a valid email address on file to receive messages. You can update your contact preferences in your account settings.

5. Termination, Eligibility, suspension
Fontsera reserves the right to monitor downloads and user activity to ensure compliance with the terms of these Terms and the License Terms, which it may update from time to time. We may, without notice, change the Service, stop providing the Service or features of the Service, or create usage limits for the Service. We may permanently or temporarily terminate or suspend your access to the Service without notice or liability for any reason, including if in our sole determination you violate any provision of these Terms such as, but not limited to, pornography or obscenity. or for no reason.
The Terms will remain in effect even after your access to the Service is terminated, or your use of the Service ends.

6. Prohibited Uses
You agree not to engage in any of the following prohibited activities:
• Use the fonts in pornographic, fraudulent, immoral, infringing, illegal, harassing, offensive, or defamatory material, is strictly prohibited
• Interfere with or try to disrupt our Services, for example by distributing a virus or other harmful computer code.
• Crawl, scrape, or spider any page of the Services or to reverse engineer or attempt to obtain the source code of the Services.
• You will not violate any laws in connection with your use of the Services. This includes any local, state, federal, and international laws that may apply to you.

7. Free Fonts.
You’re able to add free fonts by checking the “Free Product” checkbox in the Shop Manager and it will automatically become a free item. You will now find this item on the free font page. For these free fonts, no earnings will be paid.

Free Fonts only visible via direct URL link and in the Free Fonts page. These Free Fonts are not visible in the category, seller’s shop page.

8. Fonts Delivery. 
Fonts are available once your payment is confirmed, with no barriers to immediate download. Whenever required, all fonts files should be hosted on Fontsera. You must not require a Buyer to provide personal information in order to access licensed Assets If you paid with PayPal on Fontsera, confirmation might take a few minutes.
We’ll also send you a download notification email separate from any transaction notification emails you receive from PayPal.

9. Refunds and cancelations
Because of the nature of these fonts we offer are Digital downloads, We don’t offer returns, refunds, exchanges, or cancellations. your purchase is only eligible for a refund in the following situations :
• The fonts are defective and the problem is reported to support@fontsera.com within 7 days of purchase(s).
• You purchased two licenses for the same product accidentally. We'll gladly refund you for the duplicate purchase(s). 
• File is misrepresented in its product description in terms of file types or when an item stated to be included is not delivered.
Unfortunately, we will not be able to make any refund in respect of your purchases if your request for refund is due to the following situations:
• You purchased the product by accident or you’ve changed your mind about your purchase. 
• You don’t have sufficient expertise or the correct software to use the product.
• You or your client no longer needs the product or found another product you like better.
• You have trouble downloading the product. First contact shop owner or let us know, our support team will assist you to get your files. we’ll be happy to help you!

You understand and agree that Fontsera has no obligation to provide refunds on any licensed fonts. You agree that any and all refunds are provided at the sole discretion of Fontsera.

10. Your Content
Content that you post using our Services is your content (so let’s refer to it as “Your Content”). We don’t make any claim to it, which includes anything you post using our Services (like shop names, profile pictures, listing photos, listing uploads, listing descriptions, reviews, comments, usernames, etc.).
A. Responsibility for Your Content. 
You understand that you are solely responsible for Your Content. You represent that you have all necessary rights to Your Content and that you’re not infringing or violating any third party’s rights by posting it.
B. Permission to Use Your Content.
By posting Your Content through our Services, you grant Fontsera a license to use it. We don’t claim any ownership to Your Content, but we have your permission to use it to help Fontsera function and grow. That way, we won’t infringe any rights you have in Your Content and we can help promote it.
C. License You Grant Fontsera. 
By posting Your Content on the Service, you grant Fontsera a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable, perpetual license to use, display, edit, modify, reproduce, distribute, translate,  store, and prepare derivative works of Your Content. This allows us to provide the Services and to promote Fontsera, your Fontsera shop, or the Services in general, in any formats and through any channels, media or technology, whether now known or hereafter developed, for use in connection with the Service and Fontsera’s business, including without limitation for promoting and redistributing part or all of the Service (and derivative works thereof) in any media formats and through any media channels .You agree not to assert any moral rights or rights of publicity against us for using Your Content. You affirm that any listed fonts are cleared to be sold under the Fontsera Licenses. You also recognize our legitimate interest in using it, in accordance with the scope of this license, to the extent Your Content contains any personal information.

11. Payout and commission
A. Commission.
Sellers earn 50% commission on every sale. We cover customers payments processing fees and marketing expenses that help you earn more money.
B. Payout.
Payout requests may only be made if you have accumulated at least US$20 in your balance.
Payout typically takes around 10-15 business days from date of submission. Payout processing time can vary. Weekends and public holidays can increase the time for you to receive a payout.
Commissions to you are paid by PayPal only. We cannot send checks, cash etc. You are required to have a PayPal account to receive commissions. If you don't have a PayPal account you can sign up for one at any time, but you will not be paid until you have one.
If our payment processor charges payment processing fees for the commission payments, you are responsible for paying these fees.

12. Font Packs by Fontsera
By including Your Items in any Fonts Pack (Bundle), you grant Fontsera a license to use it. We don’t claim any ownership to your items, but we have your permission to sell them for a short period on behalf of you.
• After the Fonts Pack expiration, Fontsera will retain access to the files in-definitively, purely for administration purposes to assist with customer purchases.
• You may not cancel your participation from the Fonts Pack within a 10 days period prior the launch date.
• You may not remove your items from the Fonts Pack at any point until the expiration date listed in the invitation.
• You’ll receive a variable commission per Fonts Pack sale which will be listed in the invitation.
• Re-launch of the Fonts Pack will be re-negotiated and agreed with you in full prior to their commencement.
• Earnings will be paid within 10 working days of the Fonts Pack expiration date listed in the invitation via PayPal.

13. Intellectual Property
The content uploaded on Fontsera's marketplace is generated by independent sellers who are not employees, agents, or representatives of Fontsera. Sellers are responsible for ensuring they have all necessary rights to their content and that they are not infringing or violating any third party’s rights by posting it.
Fontsera reserves the right to remove any listing, shop, or account that we believe violates our Terms of service. Fontsera also reserves the right to take action against abusers of Fontsera’s Terms of Service.
Reporting Unauthorized Content: If content that you own or have rights to has been posted to the Services without your permission and you want it removed, please contact us, Fontsera will remove material cited for alleged intellectual property infringement when provided with a proper notice,
Fontsera can’t speak on behalf of intellectual property owners, nor is Fontsera in a position to offer legal advice or make legal determinations whether a shop’s content infringes someone else’s intellectual property.

14. Disclaimer of Warranties and Limitation of Liability
You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.
We do not guarantee that the services will be secure, accurate, reliable or available at any particular time or location; any defects or errors will be corrected; the services will be free of viruses or other harmful materials; or the results of using the services will meet your expectations.
You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall Fontsera our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

15. Indemnification.
You agree to defend, indemnify, and hold harmless Fontsera and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
You agree to defend, indemnify, and hold harmless Fontsera and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from and against any claims, actions, or demands, including without limitation reasonable legal and accounting fees, arising or resulting from your breach of these Terms or your access to, use, or misuse of the Services or Content. Fontsera shall provide notice to you of any such claim, suit, or proceeding. Fontsera reserve the right to assume the exclusive defense and control of any matter which is subject to indemnification under this section. In such case, you agree to cooperate with all reasonable requests to assist Fontsera in defense of such matters.

16. Third-Party Services.
Where our site contains links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them. all of which have separate privacy and data collection practices, independent of Fontsera, These linked sites are only for your convenience and therefore you access them at your own risk. We have no control over the contents of those sites or resources.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website.
